Terms of Service

1. Acceptance of Terms
By using FestivalLuts ("the Platform"), a hobby project built and operated under the project name Prioxy Studios by two people in the Netherlands, with Stijn Tilborghs responsible for it (not a registered company), you agree to these Terms of Service. If you do not agree, please do not use the platform.
2. User Accounts
- You must sign in with a valid Google account to upload content
- Accounts and uploads are for people aged 16 or over, or younger with a parent's or guardian's permission. Browsing and downloading need no account. Signing in with Google is subject to Google's own age rules
- You are responsible for all activity under your account
- We reserve the right to suspend or terminate accounts that violate these terms
3. Content Uploads
By uploading LUTs or other content to FestivalLuts, you represent and warrant that:
The upload form asks you to confirm the first point below before every upload. A file you bought or downloaded from someone else is not yours to share here, even for free.
- You are the creator of the content or have the rights to distribute it
- The content does not infringe on any third-party intellectual property rights
- The content does not contain malware, viruses, or harmful code
- You grant FestivalLuts a non-exclusive, worldwide, royalty-free licence to host, display and distribute the uploaded content on the platform, and to let the people who download it use it under section 5 (or under the licence you state on its page)
4. Content Guidelines
The following content is prohibited:
- Copyrighted LUTs from other creators or companies (e.g., paid presets redistributed for free)
- Malicious files disguised as LUT files
- Content promoting hate, violence, or illegal activities
- Spam or duplicate uploads
5. Downloads
All LUTs on FestivalLuts are provided free of charge for personal and commercial use, unless otherwise specified by the uploader. Attribution to the original creator is appreciated but not required.
FestivalLuts is not affiliated with, endorsed by or sponsored by any festival, artist, camera maker, software company or film brand named on the site. Names such as Sony, Canon, ARRI, RED, Panasonic, Apple, DJI, DaVinci Resolve, Premiere Pro or Final Cut Pro are used only to say which footage or software a LUT works with.
6. Reports, Copyright and How We Moderate
How we moderate. Uploads are checked automatically against a list of prohibited words when they are uploaded or edited. A person looks at content when a report or complaint reaches us, or when we review the catalogue ourselves. We do not review files before they are published.
Reports. Anyone can report content they believe is illegal or breaks these terms, including a copyright owner whose work was uploaded without permission. Use the report form, or email [email protected]. A report needs: the link to the content, why you believe it is illegal or breaks these terms (for copyright, which work it copies), your name and email address, and a statement that you believe in good faith that it is accurate and complete. The report form confirms receipt straight away and gives you a reference; we confirm a report sent by email by replying to it. We decide without undue delay, and tell you the decision and how to contest it. When a copyright report is credible, we remove the content first and look at any response afterwards.
Decisions about your content or account. If we remove your content or suspend your account, we tell you what we did and why. We also tell you whether a report or our own review led to it, and how to ask us to look again. You find this under "Decisions about your uploads" in Settings. Decisions are made by a person, not by an automated system. To contest one, email us the evidence (for example, a licence for the file). We look again within five working days, and restore the content if the decision is not upheld. You can also complain to the Autoriteit Consument & Markt or go to court.
Repeat infringement. An account that receives three upheld copyright reports within twelve months may be suspended. We apply these rules diligently, objectively and proportionately, with regard to everyone's fundamental rights.
7. Advertisements
FestivalLuts displays advertisements via Google AdSense to support the platform. By using the platform, you acknowledge the presence of ads during your browsing and download experience.
8. Disclaimer
FestivalLuts is provided "as is" without warranties of any kind. We are not responsible for any damage caused by content downloaded from the platform. Always scan downloaded files with antivirus software.
9. Limitation of Liability
FestivalLuts shall not be liable for any indirect, incidental, or consequential damages arising from the use of the platform. Nothing in these terms limits liability for intent or gross negligence, or any other liability that the law does not allow to be limited.
10. Changes & Governing Law
We may change these terms. The date at the top shows the current version; a change applies from that date and never to anything that happened before it. These Terms of Service and any dispute arising from the use of FestivalLuts are governed exclusively by the laws of the Netherlands.
